Agreement between User and www.right-away.com

Visiting the Platform and Electronic Communications: When you visit www.right-away.com and our App or send emails to Right-Away, you are e engaging in electronic communications. By doing so, you are giving your consent to receive electronic communications from us. Furthermore, you acknowledge that any form of communication we provide to you through electronic means – whether it is via email, on our website, or through our mobile applications – meets the legal requirement for written communications.
Account Responsibilities: If you choose to use this platform, it becomes your responsibility to safeguard the confidentiality of your account credentials, including your password. In addition, you are required to limit access to your computer and mobile devices to prevent unauthorized use. It's important to understand that you are accountable for all activities that take place under your account or password. Transferring your account to another person or entity is not allowed. It's important to note that Right-Away cannot be held liable for any unauthorized access to your account due to theft or misuse.
Children Under Seventeen: Right-Away takes privacy seriously, particularly when it comes to children. For this reason, we do not knowingly collect any personal information from individuals under the age of seventeen, whether it's done online or offline. If you are below the age of 17, you are only permitted to use www.right-away.com with explicit permission from a parent or guardian.
Key Definitions: To ensure clarity, several key terms are defined:
- · A "Customer Member" refers to a registered user (Right-Away-Requester) who uses the platform to engage in Pro Services.
- · A "Service Member" is a registered user (Right-Away-Tasker) who uses the platform to offer or provide Pro Services.
- · "Pro Services" encompass the various services that Service Members provide, and that Customer Members request, through the platform.
- · The term "Platform" is all-encompassing, referring to Right-Away websites, applications, software, and services.
- · "Content" refers to a wide range of materials available on the Platform, including text, images, reviews, and more.
Eligibility and Use of the Platform: This section outlines that access to and use of the platform is limited to individuals who are at least 17 years old and can legally enter into binding agreements. By using the platform, you are confirming that you meet this eligibility requirement. Furthermore, Service Members offering Pro Services are required to have the necessary qualifications and adhere to relevant laws. It is important to note that Right-Away's role is not in providing the actual Pro Services; rather, it provides a platform for interactions between Service Members and Customer Members.
Your License to Use the Platform: Upon adhering to the terms, Right-Away grants you a limited license that allows you to use Collective Content for personal, non-commercial purposes. This license is applicable to your participation in the platform. However, it is crucial to understand that you cannot
exploit, distribute, or modify the platform or any Collective Content unless expressly permitted in the terms.
User Content: You are given the opportunity to post User Content on the platform. By doing so, you grant Right-Away a broad license to use this content for promotional purposes. However, you are solely responsible for the accuracy and legality of the content you post. Additionally, Right-Away reserves the right to edit or remove User Content if deemed necessary. It's your responsibility to ensure that your User Content doesn't infringe upon the rights of others.
Prohibited Activities: This section outlines several activities that are prohibited on the platform. This includes activities such as misrepresentation, using automated systems without approval, copying copyrighted text, and engaging in fraudulent conduct. These prohibitions are in place to maintain a fair and ethical environment on the platform.
Right-Away Fees: To utilize certain services on the platform, Right-Away charges Fees. Service Members, also known as Right-Away-Taskers, are required to pay these Fees to access specific services, including being connected with and receiving contacts from Customer Members or other individuals. As a Service Member, your stored payment method will be automatically charged when Right-Away-Requesters or other individuals contact you. Furthermore, Fees for additional products or services will be presented to you before use.
Tracking Communications: To ensure that Fees are properly enforced and to prevent fraudulent activities, Right-Away may track communications that occur between Right-Away-Requesters and Right-Away-Taskers outside of the platform. This can include communication through emails, phone calls, SMS text messages, and other means. This tracking helps maintain the integrity of the platform's services.
International Users: If you access the platform from outside the USA, it's your responsibility to adhere to local laws. The platform is controlled and operated from the USA, and you agree not to use the Right-Away content in any manner or country where it's prohibited by local laws.
Disputes Between Users: While Right-Away encourages users to independently resolve disputes, there may be cases where mediation is necessary. Right-Away can facilitate neutral mediation to address disputes related to interactions on the platform.
Indemnification, Arbitration, and Liability Disclaimer: These sections cover your responsibilities, the arbitration process for dispute resolution, and a disclaimer outlining Right-Away's limitations of liability.
No Endorsement: It is important to understand that Right-Away does not endorse any users or services on the platform. Additionally, Right-Away is not a party to any agreements made between users.
Termination and Access Restrictions: Right-Away reserves the right to terminate access to the platform and its services at its discretion. If any disputes arise, you agree to jurisdiction and venue in Pennsylvania for dispute resolution.
Modifications: Right-Away retains the right to modify these terms with appropriate notice. Your continued use of the platform indicates your acceptance of these modifications. It's important to periodically review the Terms to stay informed about any updates or changes.

Tasker Cancellation Policy
In addition to the existing Terms and Conditions outlined above, the following points shall govern the policy regarding Tasker cancellations:
Use Case 1: Tasker Cancels a Job and Another Tasker Gets Assigned
If a Tasker cancels a job and another Tasker is successfully assigned to that job, there will be no penalty imposed on the cancelling Tasker. However, it's important to note that the cancelled job will count as one of the Tasker's three allowed cancellation attempts for the current month. The count of cancellation attempts for the Tasker will be refreshed at the beginning of each month.
Use Case 2: Tasker Cancels a Job and Another Tasker Doesn't Get Assigned
In this scenario, the penalties for Tasker cancellations will vary based on the time remaining until the scheduled job:
- · Cancellation More than 24 Hours in Advance: No penalty will be applied. If a cancellation occurs with more than 24 hours remaining until the scheduled job, there will be a 0% penalty. This is applicable when a Tasker cancels and we are still unable to assign a replacement Tasker within the given 24-hour timeframe. This scenario will be treated as a supply issue that needs to be addressed.
- · Cancellation within 6 to 24 Hours: A penalty of 5% of the job's value will be deducted. If a Tasker cancels a job within 6 to 24 hours before the scheduled time, a deduction of 5% of the job's value will be applied as a penalty.
- · Cancellation Less than 6 Hours: A penalty of 10% of the job's value will be deducted. If a Tasker cancels a job less than 6 hours before the scheduled time, a deduction of 10% of the job's value will be applied as a penalty.
The penalties charged to the Tasker will be offset from their next Payout. This means that the penalty amount will be deducted from the Tasker's earnings during their next payment cycle.
Furthermore, in situations where a replacement Tasker cannot be assigned, resulting in the cancellation of the job, the Requester will be entitled to a 100% refund. If we are unable to find a replacement for the Tasker, the Requester will receive a full refund for the canceled job.
